Shareable Diagrams to explain NBC


  I have been working around this subject for a long time now. I have decided to create a couple of visual aids to help explain how one cannot be a natural born Citizen if they are born to a foreign parent or in a foreign country. Feel free to share as you like.

The quote at the top is the requirement as established in Art. II Sec. I Cl 5 of the Constitution of the United States. (1787)

The quote on the side is the ONLY definition found in any law book of the time in which the Constitution was drafted. It is from 

The Law of Nations, Or, Principles of the Law of Nature, Applied to the Conduct and Affairs of Nations and Sovereigns, By Emmerich De Vattel (1758)

The quote on the bottom is from a letter penned by John Jay to George Washington. (25 July 1787).

The top diagram depicts (L-R) a child born in the United States to two U.S. Citizen parents, and the resulting citizenship which is one of a child who has only allegiance to the United States as derived by birth location and parentage. 

The bottom diagrams of each of the examples depicts (L-R) a child's location of birth, and the parentage of each of the parents. At the end of the diagram, it depicts a child with multiple, sometimes three different potential claims to citizenship.

Both Marco Rubio and Ted Cruz have an additional issue, and that is the fact that Cuba does not recognize the foreign citizenship of anyone born in Cuba and that extends to their children. Dual Nationality
The Government of Cuba does not recognize the U.S. nationality of U.S. citizens who are Cuban-born or are the children of Cuban parents. These individuals will be treated solely as Cuban citizens and may be subject to a range of restrictions and obligations, including military service. The Cuban government may require U.S. citizens, whom the Government of Cuba considers to be Cuban, to enter and depart Cuba using a Cuban passport. Using a Cuban passport for this purpose does not jeopardize one's U.S. citizenship; however, such persons must use their U.S. passports to enter and depart the United States. There have been cases of Cuban-American dual nationals being forced by the Cuban government to surrender their U.S. passports.
